How Much Does a Car Accident Attorney Cost?
After a car accident or other injury, many people hesitate to hire an attorney because they believe an attorney’s help is something they can’t afford. However, attorney fees don’t have to be complicated. By knowing how much an attorney will cost—and other fees you might expect—you can put your mind at ease.
No Pay Unless You Win
Most attorneys use contingency fees. This is a sum of money that the attorney receives only if their client wins the case. When you see billboards or commercials advertising that you will not have to pay your attorney “unless you win,” this is referring to a contingency fee. The percentage that a personal injury attorney receives if their client wins their case varies, but it typically ranges from 25 to 40%, with an average of 33%. For example, a client wins a $100,000 verdict and their attorney has a contingency fee of 33%, then the attorney will receive $33,000.
The contingency fee can depend on many factors, such as:
- If the case goes to trial or is settled outside of court
- If the client has a claim filed against them by the defendant
- The severity of the case
There may be other expenses that you are expected to cover throughout your case. These can include:
- Court fees
- Litigation expenses
- Fees for obtaining medical records
- Fees for obtaining police reports
- Court reporter fees
- Expert witness fees
If you are expected to pay for other fees, your attorney should let you know up-front or the information should be included in your contract.
Most personal injury attorneys offer a free initial consultation. During the consultation, you can ask them questions to make sure they’re the right fit for you and your case, and can also ask about fees or if they use a contingency fee model. Knowing what they charge and how much they’ll take can help you determine if an attorney is right for you.
